As more and more people become aware of the importance of data privacy, there is increasing pressure for businesses to be compliant with the General Data Protection Regulations. The GDPR is a far-reaching law that is considered the toughest data security and privacy law in the world. Its aim is to empower users by allowing them to control how their data is collected, processed and used.
Although becoming compliant with the GDPR requires a lot of effort on the part of businesses, it also brings with it many benefits. For instance, clients and business partners are more likely to deal with a company if they know that it is exerting every effort to safeguard their personal data. GDPR compliance can also help a company improve its data management process.
Here are some of the essential things you need to do to become compliant with the GDPR:
Map the personal data you collect. Create a data map that shows what personal data your company holds and how it flows through your organization. For instance, the map could cover what personal data you collect, how it was collected, why it was collected, how it is stored and processed and when it is disposed.
Update your Privacy Policy. Every website must have a Privacy Policy that informs users about what personal data you collect and how it will be used. In addition, to ensure GDPR compliance, you also need to add the following:
Your legal basis for collecting and processing their data
How long you will keep their data
Users right to complain if they are unhappy with how their data is being handled
Review your consent policies. You must make sure that when you get users consent, it meets GDPR standards. For instance, if your site collects cookies, there must be a cookie collection notice that specifies how the data will be used and requires users to specifically give their consent.
Create procedures to detect, investigate and report data breaches. Under the GDPR companies must report data breaches to the Information Commissioners Office if the user is likely to suffer damage, such as identity theft.
If you run an email list, use a double opt-in. When a new subscriber signs up to become a member of the list, you should ask them to consent twice: once when they sign up, and the second time by sending them an email with a confirmation link. Users should only be considered subscribed when they click on the link.
Implement an age-verification process. The GDPR only allows data processing for users who are at least sixteen; if you have to collect data from users younger than 16, you must establish a parental consent process to be able to legally do so.
Hire a Data Protection Officer. Also known as a Chief Privacy Officer, the DPO is responsible for overseeing your data protection strategy. Their duties include training staff on compliance with the GDPR and other relevant data privacy laws; creating and implementing data protection policies; and responding to access requests from data subjects.
