Among the major problems that almost every government across nations debate over is the issue of legalizing abortion. Because a big proportion of all government officials' responsibilities is to ensure that all laws passed must be for the welfare of the general public, the move to legalize abortion have always been debatable, due to differences in the public's opinion towards it.
Pro-life activists believe that abortion is also a form of murder, since the fetus - the baby, is already a human being that was not given the opportunity to live. But pro-choice activists argue, "When does life begin?" Could the fetus be already considered a human being days after conception? And how about the mother, especially if she is not ready to be one, isn't it her right to choose the life she would live?
People are raised differently, leading to different views and morals. Because morality is at stake, the passage of laws legalizing abortion is always dramatically difficult.
In the US, most experts in the world of politics express their views on the issue of abortion through the Roe vs. Wade case. This is a 1973 case where the Senate ruled that a person has the right to choose whether she will abort pregnancy, but not when the fetus is already viable. This ruling, however, did not conclude that abortion is already legal.
Another consideration is the transfer of federal funds. It is a common doing for federal governments to subsidize part of any individual's major needs, especially in the field of health. Of course, abortion is a health concern and it needs careful attending to the mother. But federal funds are from the public's taxes. If abortion would receive subsidy, it's as if even those not for abortion paid for it. Hence, a Hyde amendment was enacted. This protected the rights of pro-life activists by preventing their taxes from being used in any activities related to abortion. Abortion then became one of those which would not receive federal funding support.
Apart from the prevention of funds to be used in abortion, it was later ruled that support must also not be given to organizations performing abortion nor activist groups encouraging women to choose abortion.
After more debates, news came out that President Obama released an executive order that further prevents the inclusion of abortion in insurance plans. This is again was spurred by active pro-life groups. They did not stop there. In 2003, pro-life representatives became successful in pursuing the partial-birth abortion ban. Since then, the Senate focused more on other protection-oriented laws.
It was later enacted that minors are not allowed to move from one state to another for the purpose of abortion, without the parents' consent.
To date, there are still debatable issues concerning abortion to be discussed in the Senate. For instance, do restrictions in abortion provide exemptions when it comes to rape or incest? To clarify these, congressional decisions always undergo deep consultations. It is imperative that the government take precautions when discussing these matters, for these will greatly affect the society being governed.
