After my last post on automated text production I explore how we distinguish and create intellectual property and not plagiarized content. Serious business, plagiarism. It means theft of another's property.
Our brains are not owned by another, nor are our ideas. Our ideas are fed by those of others. In this context, we imbibe their penned ideas internalizing those arguments and ponder their meaning. In the process, we generate our own intellectual intuitions, take positions, putting our interpretations on others' ideas.
, if we commit the product of this creative effort to published media we can claim author's rights.. To me this means we can legally protect the EXPRESSION of our thoughts - but not thoughts themselves. If they are not verbalized they remain trapped in us, and no author's rights affix to them.
Thoughts are in our head and in our consciousness. In a world of 7 billion brains, it's likely that others nurture, are gestating, or even have had, those same thoughts. Those ideas and the intellectual effort associated with their production, just continue residing in THEIR brains. Its just that most of those owners of those thoughts, did not act on them. They did not articulate the idea in an EXPRESSED medium that others could cite.
The "intellectual property" was never realized; it remained buried in their thoughts. An act converting their thoughts and ideas into "Property' was never consummated. The ideas may still repose in their intellectual consciousness, but it remains only an intellectual asset captive in themselves.
Now we DO feed off the EXPRESSED ideas, concepts and thoughts of OTHERS. Applying our own intellectual talents we can, and indeed do, re-express the whole collective of others' ideas in our own way. This new assemblage of thoughts are words that emanate from our brain, products of our intellectual effort.
Those past intellects took the trouble and time to express their careful thoughts in some documented fashion. We do this to respect their intellectual effort and resulting copyright. Since the development of the Printing Press, society's progress has been boosted by this serial application of the mental and intellectual capacity of mankind.
It seems that the intellectual ASSET is transformed into intellectual PROPERTY when some impersonal acknowledgment of their actually existing occurs. A song is released, a movie is launched, a video documentary is broadcast, an essay is included in a magazine, a novel is published, a sculpture is displayed, etc. Publication confirms the author's thoughts into property. Over this work they can take possession of that special class of commercial asset - intellectual property.
In an information era where "Content is King" this kind of asset has assumed paramount importance to businesses. Think Google, Apple, Microsoft, the Economist and People magazines.
I offer these observations to help identify sequences in the Intellectual Process that can be to robotized. Aspects of traditional intellectual endeavor which can be done using computer software. Products that I referred to earlier which are radically transforming human intellectual endeavor.
Here I've qualified the origination of our intellectual property, our expressed thoughts, from that of others. In my coming blog I will apply this process to the more mundane use of "spinning" applications. Tools that, if used responsibly, expedite production of genuine content, particularly for sharing online.
