Both the lawyer of the plaintiff and the federal lawyer of the defendant go head to head in a battle of wits and eloquence when the actual trial commences. After all, this is the place where the crime is being dissected in order for the defendant or suspect to be found truly guilty of perpetrating that crime beyond reasonable doubt.
The first step in the trial process is voir dire, or the selection of potential jurors for a particular case. In the case of a criminal trial, the jury must consist of twelve select jurors. Voir dire means "to speak the truth".
The second step in the trial is the preliminary hearing, or the guilt stage. Here, the plaintiff's side delivers the opening argument about the case. Afterwards, the defense side, which is usually represented by the federal lawyer of the defendant, can optionally present its side of the case. Next, the evidence is exhibited alongside witnesses that may or may not implicate the defendant. The defense side will then have the chance to refute the evidence, cross-examine the plaintiff's witnesses, present its own set of evidence, and bring on its own set of witnesses - all for a shot at the defendant's acquittal. The plaintiff's side will also try to refute the arguments being dished out by the defense.
The jury will then decide one of two things: there is enough power to convict the defendant on the guilt of the crime, or the arguments are not enough and more of them must be tossed back and forth to reach a conclusive decision. Once the first condition is clinched by the jury, closing arguments must then be presented by the following parties in the correct order: the plaintiff's side, the defense side, and then the plaintiff's side again. The plaintiff has to present two different closing arguments since it has the onus of proving the crime. After that, the jury will rest and deliberate on the verdict. The verdict is then finally handed out .
If the defendant is indeed guilty of the crime according to the verdict, the jury still has one whole sentencing stage to administer the correct punishment to the guilty party. The federal lawyer of the defendant will then inform the defendant of his/her right to allocution, or the formal appearance in court once the sentence is handed down. The plaintiff will always inform the defendant of the impact of the crime on his/her overall life.
The verdict and the appropriate punishment may have been handed out and the trial is formally over , but the federal lawyer of the defendant still has some aces in the hole in order to reverse the defendant's fate. Besides the appeal, there is also the habeas corpus option as well as asking the sitting president for clemency.
