DUI Defense Law was formally recognized by the American Bar Association as a specialty area of Criminal Defense Law in 2003 which is somewhat surprising as driving and drinking accidents had been taking place throughout the country for decades. Fortunately, criminal defense lawyers had already identified the need for a better understanding of DUI law even before the ABA's formal recognition of it came into effect.
The year 1995 saw the establishment of the National College of DUI Defense, Inc., which is a non-profit organization committed to improving the practice of law that defends the rights of those who have been accused of driving and drinking. NCDD was founded by an assembly of seasoned criminal defense trial lawyers, some of whom are now among the country's top DUI practitioners. Current college members are regarded as some of the most experienced DUI practitioners in all 50 states, the District of Columbia, and Puerto Rico.
The NCDD was established because its founding members realized the inherent complexity of DUI cases in general and that something had to be done to ensure the lawyers who practiced such cases fully understood all of the processes involved. Such understanding by a lawyer will guarantee an accused person gets the strongest possible defense for his or her case. Specifically, a defense counsel has to be very familiar with a wide variety of legal issues (e.g. search and seizure, due process, evidence) and scientific areas of expertise (e.g. biology, chemistry, toxicology). He or she must also have a better understanding of the operation of testing equipment used to determine an accused person's precise amount of alcohol intake.
The NCDD has been headquartered in Montgomery, Alabama, since it was first established, but four major seminars are held every year at various legal institutions throughout the country. These include a Winter Session held every January at different locations, a Summer Session held every July at Harvard Law School in Cambridge, Massachusetts, an October Seminar in Las Vegas, and a seminar on Mastering Scientific Evidence. In addition to these four major seminars, each NCDD member is required to participate in at least one state seminar every two years. State seminars are sponsored, co-sponsored, or accredited by the college and are more numerous and are thus conducted in more locations, but the scope of each seminar is significantly smaller.
All NCDD and NCDD-approved seminars provide DUI Defense practitioners from all over the country with advanced-level training on such subjects as developing trial skills for driving and drinking cases, methods for creating effective opening statements and closing arguments, techniques in cross-examining investigators and resource persons presented by the prosecution, and making the most effective use of defense expert witnesses. Those who attend and successfully complete the seminars are certified as experts on DUI law by both the NCDD and the ABA. Certification by the ABA is recognized in 20 states, thus encouraging more DUI practitioners to sign up for the curriculum that is sure to give them a significant edge in the conduct of their profession both in and out of the courtroom.
