The violent crime reduction act was brought out in 2006 in response to increasing misuse of imitation firearms and air weapons, and the acquisition of primers for ammunition for criminal purposes. Part of the act also deals with the sale of knives and other weapons such as crossbows. This act also increased the penalties for related offences such as possession of weapons in a public place.
Section 31 of the Act makes it an offence for anyone to sell or transfer an air weapon 'by way of trade or business' unless they are registered with the police as a firearms dealer. On the 6th April 2007 part of Section 31 came into effect to allow traders to apply to become registered as a firearms dealer.
Air weapons in this act means those that are low powered and not deemed to be especially dangerous i.e. air rifles not exceeding 12 foot pounds (ft lbs) and pistols not exceeding 6 ft lbs muzzle energy.
All sales of air weapons must now be done in person, face to face. Sales over the internet and mail order are no longer permitted.
However people can still purchase airsoft or bb guns which are considered unrealistic. The sale of these items is permitted over the internet and mail order to anyone over the age of 18, no license is required, the trade does not need to be face to face and the dealer does not need to be a Registered Firearms Dealer as is required with realistic airguns.
The Act makes it illegal to sell unrealistic & realistic imitation guns to anyone under the age of 18 years of age; this also applies to knives and crossbows. The Act states that an imitation firearm is to be considered distinguishable from a real firearm if its size, shape or principal colour is unrealistic for a real firearm. Accordingly, to provide business with a degree of certainty about what can be traded in, the regulations specify that imitation firearms with a height less than 38mm and a length less than 70mm would be considered unrealistic. Additionally, imitation firearms which are transparent; bright red; bright orange; bright yellow; bright green; bright pink; bright purple; and bright blue are considered non-realistic colours.
