Fences have been used extensively since ancient times for various purposes. The most common reasons why people use fences is to keep something in (e.g., livestock), keep something out (e.g., wild animals), or for safety and defense. The materials used in fencing depend on what is locally available such as stone and wood. In terms of complexity, it depends entirely on the reason for erecting one and the imagination of the builder.
Through the centuries, fences have developed into structures which not only serve utilitarian purposes but aesthetic ends as well. As human existence became more complex, the use of boundary fencing also followed suit. Today, fences serve a lot of purposes and are made of different kinds of material in a myriad of configurations. Hence, fences have become as important as the structure or property it protects or encloses.
In the City of Perth, Western Australia a number of requirements are enforced in relation to the erection and repair of fences. Though majority of boundary fencing-related work do not need approval from the City, it pays to know which ones need approval. Doing so saves time, money, and other resources in the long run.
The best approach in properly erecting or repairing a boundary fence is to go back to the basics and define what a fence is. Based on the definitions found in the Dividing Fences Act of 1961, a dividing fence or a boundary is a fence constructed to serve as a demarcation between properties. A dividing fence may be constructed on top of a common boundary or adjacent to a common boundary. Meanwhile, the term sufficient fence is described as a type of fence constructed based on guidelines set by local law. Alternatively, it could also be defined as a fence for which the construction and other aspects have been agreed upon by every party involved.
In cases where there is no such law or agreement can be used as basis, any fence capable of limiting the movement of cattle or sheep or any fencing determined by the court of law can be considered as a sufficient fence. In the City of South Perth, a fence is defined as a structure or hedge constructed on top of a common boundary in the middle of adjoining lands or within 3 meters of the common boundary, serving as a demarcation between lands. The definition also applies to improvements over an existing fence, whether or not such improvements is part of or separate from the original structure; and a structure constructed to serve as a barrier separating a lot and a thoroughfare.
When measuring the height of a fence, the level of the ground adjacent to the fence shall serve as the reference point. In cases where the land is not level, the higher side shall be the basis of taking the height of the fence. These definitions were based on the city's Town Planning Scheme for fencing.
